By downloading, installing, or using the TikFanz mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our App.

These Terms constitute a legally binding agreement between you and TikFanz ("we," "us," or "our") regarding your use of the App and related services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

Description of Service

Eligibility and Registration

To use TikFanz, you must:

User Content and Intellectual Property

User-Generated Content

You retain ownership of any content you create, upload, or share through the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of providing our services.

Our Intellectual Property

The App, including its design, functionality, and content, is owned by TikFanz and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary content
• Use our trademarks or logos without permission
• Create derivative works based on our App
• Remove or alter any copyright notices

Third-Party Content

Our App may contain content from third-party sources. We do not endorse or assume responsibility for such content, and you use it at your own risk.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using TikFanz, you consent to:

Payments and Subscriptions

TikFanz offers various subscription plans with different features and pricing. Subscription fees are billed in advance on a recurring basis.

Payment Terms

• All fees are non-refundable except as required by law
• Prices may change with 30 days' notice
• Failed payments may result in service suspension
• You authorize us to charge your payment method for all fees

Cancellation and Refunds

You may cancel your subscription at any time through the App settings. Cancellation will take effect at the end of your current billing period. Refunds are provided only as required by applicable law or at our discretion.

Free Trial

We may offer free trial periods for new users. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

Termination and Account Deletion

Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in the App
• Contacting our support team
• Following the instructions in your account settings

Termination by Us

We may terminate or suspend your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• You fail to pay subscription fees
• We are required to do so by law

Effect of Termination

Upon termination:

• Your access to the App will be immediately revoked
• Your data may be deleted in accordance with our data retention policy
• Any unused subscription fees are non-refundable
• Provisions of these Terms that survive termination will remain in effect

Disclaimers and Limitations

Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or technical issues.

Accuracy of Information

While we work to provide accurate analytics and insights, we cannot guarantee the accuracy, completeness, or reliability of any information provided through the App.

Limitation of Liability

To the maximum extent permitted by law, TikFanz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Damages resulting from use of third-party services

Warranty Disclaimer

The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify, defend, and hold harmless TikFanz and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App in violation of these Terms
• Your violation of any applicable laws or regulations
• Your User Content or other materials you submit
• Your interaction with other users or third parties

This indemnification obligation will survive the termination of your account and these Terms.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which TikFanz operates, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through:

1. Good faith negotiations between the parties
2. Mediation if negotiations fail
3. Binding arbitration as a final resort

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last updated" date at the top of these Terms
• Notify you through the App or by email
• Provide a summary of significant changes

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and delete your account.
